4. User Content

You may submit, post, generate, or share content through BrainsyAI.

By submitting content, you grant Soleo Technologies a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, adapt, publish, and distribute your content solely for the purpose of operating, promoting, and improving BrainsyAI.

Users retain ownership of any intellectual property rights held in their submitted content.

5. Prohibited Conduct

Users agree NOT to:

• Use BrainsyAI for any unlawful, fraudulent, malicious, or unauthorized purposes.

• Submit content that is harassing, defamatory, abusive, hateful, threatening, obscene, or otherwise objectionable.

• Upload viruses, malware, or harmful code.

• Attempt to access systems or data without authorization.

• Reverse-engineer or copy any part of BrainsyAI.

Soleo Technologies reserves the right to suspend or terminate accounts for any violation of these rules.

6. Intellectual Property

All content on BrainsyAI, including but not limited to text, graphics, logos, software, and AI-generated outputs, is protected by intellectual property laws and remains the property of Soleo Technologies or its licensors.

Users may not copy, modify, distribute, sell, or lease any part of BrainsyAI without prior written permission.

7. Disclaimer of Warranties

BrainsyAI is provided on an “as is” and “as available” basis without warranties of any kind.

We expressly disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and system availability.

8. Limitation of Liability

To the fullest extent permitted by law, Soleo Technologies and its affiliates will not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages,

• Loss of profits, data, or goodwill,

• Damages resulting from unauthorized access, use, or alteration of user transmissions or content.

Our total liability will not exceed the greater of (i) $100 or (ii) the amount paid to Soleo Technologies by you in the last twelve (12) months.

9. Termination

We may suspend or terminate user accounts at any time for violation of these Terms or applicable laws, without notice.

Upon termination, your right to access BrainsyAI immediately ceases. You may also delete your account at any time.

10. Data Protection Rights

BrainsyAI users have specific rights under privacy laws, including:

• Right to Access: You can request a copy of your personal data.

• Right to Correction: You can correct inaccurate data.

• Right to Deletion: You can request account and data deletion.

• Right to Restriction: You can restrict processing in certain circumstances.

• Right to Object: You can object to certain processing activities.

• Right to Withdraw Consent: Where processing is based on consent, you may withdraw it at any time.

11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

All disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

We reserve the right to modify or update these Terms at any time.

Material changes will be notified via email or through BrainsyAI’s user dashboard.

Your continued use of BrainsyAI after changes constitutes acceptance of the updated Terms.
